Terms and Conditions of the Auction
 

            There is no minimum starting bid however the trustees must confirm the final high bid. The Trustees intend for the property to change ownership.

 

          The property sells “as is”, with no guarantees or warranties of any kind expressed or implied, except for title stipulations below.  This will be a CASH SALE, and not subject to buyer obtaining financing, therefore bidders should have their financing in place prior to bidding.  

 

          The high bidder, upon acceptance and confirmation by the Trustees, will be required to place a deposit equal to 10% (ten percent) of the accepted bid in the Trust Account of Keller Williams Realty, to be applied to the sale price. The balance of the sale price, plus any normal cost of transfer of real estate, and loan costs, will be due at closing, which will occur on or before Friday, July 11, 2008.   Trustees will accept or reject the bid at the time of the auction, there the transaction will be finalized at auction time.

          The earnest money deposit is to be in the form of personal or company check and is due at the conclusion of the auction. Failure to close per the terms of the contract will result in forfeiture of the deposit.

          The trust will furnish an abstract of title certified to date and commitment for title insurance.   The buyers may purchase a title insurance policy at their expense and option.
